Job Description

ESSENTIAL DUTIES AND RESPONSIBILITIES:

The Director, Global Trade Compliance will act as the global policy owner for trade and partner with various high-level stakeholders in the Company to provide guidance on trade compliance regulations, enabling the business to navigate complex trade regulatory/landscapes in a compliant and pragmatic way. Successful candidates must demonstrate their ability to:

  • Lead, manage and develop both functions (import and export) within Global Trade Compliance;
  • Direct the creation and maintenance of trade compliance policies & guidelines;
  • Provide clear and timely guidance and advice to ensure the company and its subsidiaries, affiliates, and partners comply fully with all applicable global trade laws and regulations, including the EAR, OFAC and other sanctions programs, TAA, CBP and other U.S./ international (EMEA/APAC) regulations
  • Oversee the company’s export classification, End User/End Use controls, deemed exports and RPL screening programs to ensure adequate and agile controls are in place.
  • Advise and lead on drafting of strategic export licenses and other regulatory filings such as import licenses and/or permits;
  • Manage overall trade compliance risk and direct the development of the trade compliance program’s continuous improvement activities, including compliance assurance and risk assessment programs;
  • Monitor legal, regulatory, and trade developments that impact the company’s business and deliver clear and timely legal guidance to mitigate impacts;
  • Direct, develop and implement risk-based trade compliance trainings and communications;
  • Collaborate with various business functions (including colleagues in Legal, Finance/Tax, HR, Engineering, Supply Chain, Marketing and Sales, Corporate Strategy) to understand their business priorities and build integrated, upstream and forward-looking trade compliance processes;
  • Drive implementation of third-party risk management controls within procurement and sales business processes, managing risk-based diligence process for third parties and advising the Company on distributor channel compliance solutions;
  • Lead projects to enhance trade efficiency and value contribution;
  • Lead the development of a trade roadmap and associated strategic planning; and
  • Promote a business culture of trade and ethics and conduct other compliance activities.
Qualifications
  • BS/BA degree required; graduate degree preferred
  • CUSECO preferred.
  • US Licensed Customs Broker preferred

Required Skills & Experience

  • 10+ years of direct trade compliance experience, preferably within the semiconductor or technology industry.
  • Comprehensive knowledge of US export controls and sanctions with direct experience dealing with listed parties.
  • Experience with the newly implemented US and EU sanctions for Russia and Belarus.
  • Experience with export licensing, use of license exceptions, compliance agreements & assurances (EUCs etc.)
  • Knowledge of key World Trade Organization (WTO) import compliance principles including Country of Origin determination/marking, customs valuation and Harmonized Tariff Schedule (HTS) classification;
  • Experience building/expanding a supply chain mapping transparency program along with general experience managing forced labor prevention initiatives and projects;
  • Experience overseeing trade compliance risk assessments.
  • Experience in building and leading a trade compliance function in a multinational company;
  • Strategic thought leader with business acumen and ability to make good decisions based on sound judgement;
  • Strong presentation skills and executive presence ;
  • Knowledge of international trade regulations, in addition to U.S. trade regulations
  • Experience in managing outside counsels and budget;
  • Experience in overseeing, managing and driving multi-functional projects to completion;
  • Ability to create a trusting work environment, prioritize employee strengths, and foster autonomy, leading to increased engagement and retention
  • Resilient and able to quickly adjust priorities to meet business needs;
  • Attention to detail, critical thinking, excellent problem solving and analysis skills;
  • Nimble learner and quick to learn new and different technologies and stay abreast of emerging technologies;
  • Experience working closely with government affairs function, a plus;
  • Experience with ethics and compliance program management and/or development, a plus.

  • An employee’s pay position within the salary range may be based on several factors including but not limited to (1) relevant education; qualifications; certifications; and experience; (2) skills, ability, knowledge of the job; (3) performance, contribution and results; (4) geographic location; (5) shift; (6) internal and external equity; and (7) business and organizational needs.
  • The salary range is what we believe to be the range of possible compensation for this role at the time of this posting. We may ultimately pay more or less than the posted range and this range is only applicable for jobs to be performed in California, Colorado, New York or remote jobs that can be performed in California, Colorado and New York. This range may be modified in the future.
  • You will be eligible to participate in Western Digital’s Short-Term Incentive (STI) Plan, which provides incentive awards based on Company and individual performance. Depending on your role and your performance, you may be eligible to participate in our annual Long-Term Incentive (LTI) program, which consists of restricted stock units (RSUs) or cash equivalents, pursuant to the terms of the LTI plan. Please note that not all roles are eligible to participate in the LTI program, and not all roles are eligible for equity under the LTI plan.
