What you’ll be doing:

  • Advise on labor disputes and independently handle any potential labor arbitrations, litigations.

  • Deal with daily labor law inquiries from China & HK employees, HRs and business teams and provide helpful advice to better facilitate and support the business operation, among others, give valuable advice on non-competition related inquiries, optimize case assessment process, provide executable guidelines to HRs and managers.

  • Advise on HR policies, including review, improve and update the labor related policies to keep the company operating in a high-level compliance, provide relevant training to employees, HRs, managers.

  • Address HR daily matters such as work-related injury case reviews, discussions on sick leave arrangements, retirement age inquiries, background check record reviews, prior invention and outside activity disclosure reviews, regular review of employment-related contract templates and amendments, review HR service/procurement contracts with various vendors.

  • Extensive involvement in PIP (performance improvement plan) meetings, document reviews, and result deliveries in collaboration with HR to mitigate risk for any potential labor disputes.

  • Advise on employment termination cases due to performance issue, serious violation of company polies, etc., prepare relevant documentations, participate in negotiation strategy discussions with HR.

  • Collaborate with HQ investigation team for internal investigations on employees’ misconduct cases, draft warning letters.

  • Random legal research as required by HQ for global employment compliance purpose.

What we need to see:

  • A law degree from top China law school, LLM/JD preferred but not required.

  • 7+ years' legal experience from either international law firms, reputable China law firms or MNCs.

  • Be qualified to practice law in China and holds a Chinese lawyer certificate.

  • Labor arbitrator experience preferred but not required.

  • Verbal and written fluency in Chinese/Mandarin and English for negotiations, agreement/document review, research and drafting.

  • Rich experience in handling labor arbitrations, litigations and can independently handle the labor disputes proceedings and delivery the assessment/ case status to business team and management.

  • Knowledge in dealing various employment issues under China and HK laws and internal investigation a must.

  • Deep knowledge, insight and experience in non-competition cases and can give practical advice to business team.

  • Self-educate and effectively update the legal team on an ongoing basis on relevant labor laws and regulations. Resourceful and self-reliant, especially in terms of work processing and document generation and distribution.

  • Has good presentation skills to engage in discussions with HR and business teams. Appetite to make risk-benefit analysis judgments and recommendations.

  • Highest ethics and integrity. Willing to publicly resist inappropriate internal and external business influence. Stability and strong interpersonal (EQ) skills, team player.
